Kelly M. Politte is a Denver attorney specializing in the areas of Taxation (including tax litigation and tax controversy), Estate and Gift Tax Planning, Business Planning (including entity formation and succession planning), Business and Corporate Transactions, and Probate Litigation. She represents individuals and businesses across the country.
Kelly’s tax controversy and litigation experience includes representation of individual and corporate taxpayers and accounting professionals through all facets of civil and criminal tax controversies with the Internal Revenue Service (IRS), Department of Justice, and state and local taxing authorities. Matters handled include audit navigation, audit reconsideration, innocent spouse requests, penalty abatement/appeals, employment tax and trust fund recovery penalty (TFRP) cases, collections (liens, levies and garnishments), offers in compromise (OIC), installment agreements, non-filers and voluntary disclosures, offshore tax matters including OVDP/OVDI, claims for refund, and U.S. Tax Court and district court litigation and appeals.
Kelly also represents clients in business formation, planning, transactions, and operations, as well as business litigation and disputes. She helps advise her clients regarding business formation and assists her clients to form limited liability companies, partnerships, corporations, and helps maintain their compliance with laws and rules governing their businesses. In addition, she is experienced in contract negotiation as well as business disputes, to include shareholder disputes, limited liability company member disputes, and partnership disputes.
Kelly's non-tax law experience has encompassed estate planning and administration, and probate litigation, and in this regard, she regularly prepares and reviews wills, trusts, powers of attorney, and advance medical directives and assists clients in navigating through the probate system. She also handles real property transactions.
Kelly was born in Denver, Colorado. She attended college at the United States Air Force Academy and the University of California, San Diego, earning her Bachelor of Science Degree in Psychology from the University of California, San Diego. She was honorably discharged from the Air Force in 2004. She subsequently attended the University of San Diego where she started her Masters in Business Administration, before moving to Denver. Kelly received her Masters in Business Administration from the University of Denver’s Daniels College of Business and Juris Doctor degree from the University of Denver’s Sturm College of Law. Thereafter, she received her LL.M. in taxation from the University of Denver Graduate Tax Program.
